Terms and conditions for online orders placed via saigonista.at. Last updated: 2026.

1. Scope & Contracting Parties

These Terms and Conditions apply to all orders placed via the website between

(hereinafter "Saigonista") and the ordering customer (hereinafter "Customer"). Deviating terms will not be recognised unless Saigonista expressly agrees to them in writing.

2. Conclusion of Contract

The presentation of food and drinks on the website does not constitute a binding offer. By completing the order, the Customer makes a binding offer to purchase the selected products. The contract is concluded as soon as Saigonista confirms the order by email or starts preparation.

3. Prices

All prices are in Euro and include statutory VAT. Any delivery fees will be shown separately before the order is completed.

4. Payment

Payment is made online via the payment service provider Stripe (credit card, Apple Pay, Google Pay, etc.). Payment is due upon completion of the order. Saigonista reserves the right to restrict individual payment methods.

5. Delivery & Pickup

• Pickup: Orders can be picked up during opening hours at our location at Favoritenstraße 72, 1040 Vienna. The estimated pickup time will be displayed after the order is completed.
• Delivery: Deliveries are made only within the specified delivery area. Delivery and waiting times are non-binding estimates; delays due to high demand or traffic are possible.

6. Cancellation & Withdrawal

Because this concerns the supply of perishable food and dishes prepared to customer specifications, there is no statutory right of withdrawal pursuant to § 18(1)(4) and (3) of the Austrian Distance and Off-Premises Consumer Contracts Act (FAGG) once preparation has begun.

Cancellation is only possible as long as preparation has not yet started. Please report cancellation requests immediately by phone at +43 676 904 66 99.

7. Allergens & Food Information

Information on allergens pursuant to the Food Information Regulation (FIC) is available on request. If you have known allergies or intolerances, please let us know before placing your order.

8. Warranty

Statutory warranty provisions apply. In the event of justified complaints, Saigonista is entitled, at its option, to remedy the defect or provide a replacement. Claims for damages are limited to intent and gross negligence to the extent permitted by law.

9. Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

10. Online Dispute Resolution

Consumers may submit complaints to the EU Online Dispute Resolution platform: ec.europa.eu/odr. Saigonista is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. Final Provisions

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the Customer's country of residence remain unaffected. Place of performance and – to the extent legally permissible – place of jurisdiction is Vienna.

Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
